Mr. Nishant Awana’s practice broadly covers Arbitration Laws, Banking Laws, Service matters, Corporate & Commercial law, Employment (Including Industrial disputes and workmen compensations) disputes, Consumer Protection Laws, Criminal Law and other Civil Laws.
Mr. Nishant Awana is a Master of Laws (LL.M. – Corporate and Commercial Laws) and holds his B.A., LL. B. (Hons.) from Dr. Ram Manohar Lohiya National Law University, Lucknow.
Mr. Awana has an experience in appearance before various courts and judicial forums in Delhi including the Hon’ble Supreme Court of India, High Court of Delhi, Arbitral Tribunals, National Company Law Appellate Tribunal (NCLAT), National Company Tribunals (NCLTs), etc.
Mr. Awana commenced his legal pursuits as an Associate with ACM Legal Advocates, a Delhi based law firm and thereafter, owing to his commitment and hard work, he was first promoted as Senior Associate and thereafter an Associate Partner with ACM Legal Advocates.
Mr. Awana also handles IPR litigation such as John Doe suits litigation before the Hon’ble High Court of Delhi for infringement of Trade Marks, Broadcasting rights, etc. He has dealt and handled numerous matters in the field of Banking Law, Insurance Law, Intellectual Property Rights, Insecticides Act, 1968, Negotiable Instruments Act, 1881, Petroleum and Natural Gas Regulatory Board Act (PNGRB), 2006, Central Excise Act, 1944, Electricity Act, 2003, TRAI Act, 1997 before the Hon’ble High Court of Delhi High Court, various district Courts, and Arbitral Tribunal.
Mr. Awana, besides several other important cases, was instrumentally involved in a case which involved property law and Portuguese Civil Code (which is applicable in the State of Goa) titled as Syscon Consultants Private Limited vs Primella Sanitary Products Pvt. Ltd. & Anr. (2016) 10 SCC 353, before the Hon’ble Supreme Court of India.
Besides several other important cases, I was instrumentally involved in cases:
- which involved and settled the conflict between the provisions of Delhi High Court (Original Side) Rules, 2018 and Code of Civil Procedure, titled as “Gautam Gambhir vs Jai Ambey Traders & Ors.” before the Hon’ble High Court of Delhi.
- which involved insolvency law and interpretation of the word “Operational Creditor” in respect of “Account Settlement Agreement”, titled as “Brand Realty Private Limited vs Sir John Bakeries Private Limited” before the NCLT, Delhi.
During his academic tenure, he was associated with Karanjawala & Co., New Delhi and also got an opportunity to work under the able guidance of Hon’ble Dr. Justice B.S. Chauhan, Judge, Supreme Court of India. He also have international exposure in dealing with Arbitrations while working with Kuala Lumpur Centre for Regional Arbitration, Kuala Lumpur, Malaysia.
Further, Mr. Awana has drafted and presented research papers on various social and financial issues. The topics of some of these research papers are “Combating Child Pornography and Cyber abuse”, “Natural Resources as a Path for Pro-Poor Growth: Analyzing the Political and Economical Intricacies”, “Bhopal Gas Disaster and Law: National and International Perspective”, etc.
